Terms of Sales

1. Seller
The website alinaschiau.com is published by Alina Levy-Schiau, visual artist working under the name Alina Schiau, sole proprietorship, SIREN 814 304 473, 9 rue de l'Artoire, 78610 Auffargis, France. Phone: +33 6 03 32 22 02. Email: alina.schiau@gmail.com.

2. Purpose
These terms govern the online sale, to private buyers, of the original artworks by Alina Schiau presented on the website. Placing an order implies acceptance of these terms. The applicable terms are those in force on the date of the order.

3. The artworks
Each artwork is a unique piece, signed by the artist and accompanied by a certificate of authenticity. The photographs are taken with the greatest care; slight colour variations may nevertheless appear depending on the screen used. Artworks are offered subject to availability: a sold artwork is no longer available.

4. Prices
Prices are shown in euros. Shipping costs are specified before the order is confirmed. The applicable price is the one displayed at the time of the order.

5. Order
The buyer selects the artwork, enters their details and the shipping address, accepts these terms, then proceeds to payment. The order is confirmed by a summary email. The sale is concluded upon receipt of this email. Alina Schiau reserves the right to cancel an order in the event of a payment issue or a prior dispute with the buyer.

6. Payment
The price is payable in full when ordering, using the payment methods offered at checkout. Payments are secure and processed by certified providers.

7. Delivery
Artworks are delivered within mainland France and Corsica. For any other destination, delivery terms and costs are provided on request: write to alina.schiau@gmail.com.
Each artwork is carefully packed and shipped with tracking and insurance. Delivery takes 2 to 8 business days from shipment, and no more than 30 days from the order. Details are set out in the shipping policy.
On receipt, the buyer checks the condition of the parcel and the artwork. In case of damage, the buyer records precise reservations with the carrier and informs Alina Schiau within 3 days, with photographs.

8. Right of withdrawal
The buyer has 14 days from receipt of the artwork to withdraw from the purchase, without giving any reason. The buyer informs Alina Schiau through an unambiguous statement, by email to alina.schiau@gmail.com, or using the model form below.
The artwork must be returned within 14 days of this notification, in its original protective packaging, insured for its value. Return costs are borne by the buyer. The refund, including the initial delivery costs, is made within 14 days of the notification, using the same payment method; it may be withheld until the artwork, or proof of its dispatch, has been received. The buyer may be held liable for any loss in value resulting from handling beyond what is necessary to establish the nature and characteristics of the artwork.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to artworks made to order according to the buyer's specifications.

9. Legal guarantees
The buyer benefits from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code), which may be invoked within 2 years of delivery, and from the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), within 2 years of their discovery.

10. Intellectual property
Purchasing an artwork transfers ownership of the physical object, but not the copyright, which Alina Schiau retains (Article L111-3 of the French Intellectual Property Code). Any reproduction or distribution of the artwork, in particular for commercial purposes, requires her prior written permission.

11. Personal data
Data collected when ordering is processed in accordance with the privacy policy.

12. Governing law and disputes
These terms are governed by French law. In the event of a dispute, the buyer is invited to contact Alina Schiau first to seek an amicable solution. Failing that, the buyer may refer the matter to the competent court, including that of their place of residence.
